Baker+ delivers a video on demand service which the user, based on these terms of service, can watch audiovisual material (such as films and series – hereinafter the ‘content’) online (through streaming) on fixed and mobile devices ((smart) TV, computer, smartphone, tablets, etc.), whether or not in (Ultra) HD.
This service is free of charge.
The Baker+ software, as well as its functionality and features, may vary from device to device, and their use may be subject to third party software licenses. The ability to view content available in (ultra) HD and/or HDR is subject to the internet provider and the user’s device. You can use Baker+ by surfing to bakerplus.net on fixed and mobile devices.
Baker+ can be used on several devices at the same time.
Baker+ can continuously adapt the Baker+ platform and the content on it without additional cost and prior notice to its user. In addition, Baker+ can be limited or interrupted for a certain period of time for maintenance and development, without Baker+ owning any compensation to the user. In such cases, Baker+ will, as far as reasonably possible, inform the user of this in a timely manner.
To be able to use Baker+, you do not need to create an account. You will be asked to provide certain information, such as your email, user password, name, date of birth. You guarantee that you will keep track of the data that you provide for your account and keep it up-to-date so that it is always accurate and complete. You will need to use a password to access your account. You must choose a password that is not obvious and sufficiently secure. Your password is personal and you should not share it with others. It’s your responsibility to guard its secrecy.
You are responsible for the actions taken with your account.
You must be at least 13 years of age to create an account.
Baker+ reserves the right to block your account for a specific period or permanently if you fail to act in accordance with these terms and conditions and/or applicable law. In such cases, Baker+ will not owe the user any compensation.
You can use the service of Baker+ as soon as the registration process is completed and continues until it is terminated. The right of withdrawal provided for in articles VI.47 – VI.53 CEL does not apply. Your account can be terminated at any time by going to sending a mail to [email protected]. Your account will then be removed by our support staff. After termination your access to Baker+ ends instantly.
Baker+ can, if you act in violation of these terms and conditions and/or legislation, at any time terminate your account with immediate effect, without owing any compensation.
Baker+ has the right to terminate your account without any motivation and without judicial intervention.
No monthly/annual fixed subscription fee is billed for the use of Baker+.
Baker+ reserves the right to change to a subscription model. If this is the case, Baker+ will inform you in good time. You also have the right, before the new subscription model comes into effect, to terminate your account without compensation in accordance with article III of these terms and conditions.
The Baker+ user has a limited, non-exclusive, non-transferable and non-sublicensable right of use to the content, in accordance with these terms and conditions.
The Baker+ Service and Content are intended for personal, non-commercial use only and may not be shared with anyone outside of the home environment. The content may not be modified, distributed, archived, displayed in violation of these terms and conditions, reproduced, offered for sale, licensed, used to create derivative (s) from, distributed, uploaded, publicly shown, etc. The user indemnifies Baker+ against all damage resulting from this unlawful use.
The user may not (attempt to) circumvent, remove, deactivate, limit, interfere with, etc. the provided content protection. Nor may the user manipulate, decompile, reverse engineer, disassemble, or attempt to manipulate, decompile, reverse engineer, etc.
If Baker+ determines that the user is using Baker+ and/or content in violation of these general terms and conditions and/or applicable legislation, Baker+ can block the user’s account in a timely manner or permanently and deny the user access to Baker+ and the content in a similar manner or permanently.
Baker+ excludes, insofar as legally possible, its liability for damage resulting from or related to use of Baker+, including unavailability, malfunctions and interruptions, except in the case of malicious intent or gross negligence from Baker+.
Baker+ does not guarantee continuous and uninterrupted use of Baker+. Circumstances may arise, such as (but not limited to) network overload, as a result of which Baker+ is temporarily not (fully) available. In such cases, Baker+ does not owe any (damage) compensation.
Successfully using Baker+ and receiving and playing content is subject to the technical functionalities and limitations of the user’s device. Baker+ cannot be held responsible if Baker+ cannot be used on a particular device.
Baker+ does not guarantee that the content will meet the user’s substantive expectations. Baker+ cannot be held liable for this under any circumstances.
Baker+ cannot be held liable for errors on the part of third parties with which Baker+ cooperates in the context of this Baker+ service.
The user is liable towards Baker+ for the damage that the latter would suffer as a result of the use of the Baker+ service and /or the content in violation of these general terms of service and/or applicable law.

All our communication in connection with Baker+ (in connection with your account, confirmation messages, notifications, etc.) is exclusively electronic, by email to the email address provided by you.
Your account is governed by German law, as are any disputes in this regard that we cannot resolve amicably. Such disputes are exclusively submitted to the courts in Berlin.

Baker+ can change these terms and conditions at any time. In such a case, you will be informed of this in a timely manner.
If any (part) of these general terms and conditions turns out to be invalid or unenforceable, this will not affect the validity and enforceability of the other (parts of these) general terms and conditions.
